The Biden Regime Threatens to Sue Texas If It Enforces Strict Immigration Law

On December 28, 2023, the Biden regime warned Texas that it will sue the state government if it enacts an immigration law known as Senate Bill 4 that would grant state and local law enforcement officials the power to arrest, jail, and prosecute migrants suspected of entering the country illegally. 

The Justice Department announced it would file a lawsuit against SB4 if Texas did not inform federal officials by January 3 that the state would back off from enforcing the law as planned in March, per a letter sent to Governor Greg Abbott on December 28 and that CBS News was able to get a hold of. On top of making illegal entry a crime at the state level, the law would grant Texas judges the power to issue de facto deportation orders.

In its letter, the Justice Department argued that SB4 would effectively criminalize actions that are already illegal at the federal level, deteriorate relations between the United States and Mexico, and bar officials from enforcing federal immigration laws, which includes those designed to provide refuge to migrants who are escaping persecution. 

“Because SB 4 is unconstitutional and will disrupt the federal government’s operations, we request that Texas forbear in its enforcement,” Principal Deputy Assistant Attorney General Brian Boynton declared in his letter to Abbott.

If Texas does not comply with the Biden regime’s demand, “the United States intends to file suit to enjoin the enforcement of SB 4,” Boynton cautioned.

On December 28, Abbott posted on social media that the Biden regime’s  threat of legal action demonstrated “hostility to the rule of law in America.”

The Biden regime, he continued, “not only refuses to enforce current U.S. immigration laws, they now want to stop Texas from enforcing laws against illegal immigration.”

Renae Eze, a spokeswoman for Abbott, announced that the Texas state government is ready to defend SB4 in front of the Supreme Court.  

The fact of the matter is that the federal government has no desire to enforce immigration laws. As a result, state governments like Texas will have to assume this vacuum in immigration enforcement. 

That’s the reality of an America whose federal government is fully captured by Open Borders Inc. Hopefully, Texas does not back down and continues to use state resources to stave off the massive illegal alien invasion taking place at the southern border.
